Terms and Conditions

Please read these Terms & Conditions carefully before purchasing a membership or pass. By joining Infinity Fitness, completing a health questionnaire, or using our facilities, you agree to be bound by these terms, which incorporate our Member Code of Conduct.

These terms are between you (the “Member”) and Infinity Fitness (Dawlish) Ltd, a company registered in England & Wales (Company No. 17099269), trading at Shutterton Bridge, Exeter Road, Dawlish, Devon, EX7 0LX (“Infinity Fitness”, “we”, “us”, “our”). 1. About these terms

1.1 These terms apply to all memberships, day and week passes, and use of our facilities, classes and services.

1.2 We may update these terms from time to time (for example, to reflect changes in the law or how we operate). If we make a significant change, we will give you reasonable advance notice by email or a notice at the gym. The version in force is always the one published on our website.

1.3 Nothing in these terms affects your legal rights as a consumer under the Consumer Rights Act 2015 or other applicable UK law.

2. Memberships and products

2.1 We offer the following memberships and products (current prices are shown on our Plans & Pricing page and may change in line with section 8):

  • Infinity Membership (All Inclusive & Unlimited Classes) — unlimited 24/7 gym access, the full group class timetable and the recovery suite, once 24/7 access has been set up at reception.
  • Horizon Membership (All Inclusive, No Classes) — unlimited 24/7 gym access and the recovery suite, plus one free taster class. Group classes are not otherwise included.
  • Get Into Fitness — a fixed 90-day beginner membership for people who are new or returning to fitness (not available to current gym members or regulars), with access during staffed hours only. It includes an induction, a guided first training session, an online training plan, a dedicated instructor as your point of contact, monthly check-ins and advice on longer-term membership options.
  • Spark Membership — our membership for young people aged 13–17, during staffed hours only and subject to the conditions in section 3.
  • Off Peak Membership — gym access between 10:00 and 16:00, Monday to Sunday. Access times are strictly enforced.
  • Day Pass / Week Pass — short-term access during staffed hours only.

2.2 Group fitness classes are included with the Infinity Membership only. Horizon Members receive one free taster class. Classes must be booked in advance in accordance with section 13.

2.3 Get Into Fitness runs for a fixed term of 90 days, paid either up front or monthly, and ends automatically at the end of the 90 days unless you choose to move onto one of our memberships. It does not renew automatically.

2.4 The benefits included with each membership are those listed for that plan at the time of purchase. Class timetables, facilities and equipment may change from time to time.

3. Spark Membership (ages 13–17)

3.1 Spark Membership is available only with the written consent of a parent or legal guardian, who must complete the consent and health information required at sign-up. Consent must be renewed annually or on any change of guardian. The parent or guardian accepts responsibility for the Spark Member’s compliance with these terms.

3.2 Every Spark Member must complete a full induction with a member of staff before using any gym floor equipment.

3.3 Spark Members may use the gym during staffed hours only and must not enter or remain on site outside staffed hours. Staffed hours are displayed at reception and on our website; it is the responsibility of the parent or guardian to check current staffed hours, as these may change.

3.4 Group fitness classes are not included in Spark Membership.

3.5 A parent or guardian must be contactable by telephone at all times during a Spark Member’s visit.

3.6 Spark Members must not use the sauna or ice bath (see section 11) and must follow all instructions from staff. We may refuse or withdraw a Spark Membership where these conditions are not met or where the wellbeing of the young person or other members may be at risk.

3.7 Children under 13 are not permitted to use the gym floor or any exercise equipment at any time, and may only attend the premises for approved classes or activities under direct adult supervision.

3.8 We may ask for proof of age and reserve the right to refuse access where age or consent cannot be verified.

4. Joining and payment

4.1 There is no joining or admin fee. You pay only the price of your chosen membership or pass.

4.2 Monthly memberships are paid monthly in advance by Direct Debit, collected on our behalf by GoCardless through our membership system. Your Direct Debit is protected by the Direct Debit Guarantee. Your first payment is taken at sign-up and subsequent payments on or around the same date each month.

4.3 Day Passes and Week Passes are paid for in full at the time of purchase.

4.4 If a payment fails or is not made when due, we may suspend your access until the outstanding amount is paid. We may re-present the Direct Debit and ask you to bring your account up to date. Cancelling your Direct Debit with your bank does not cancel your membership — you must give notice under section 6.

4.5 You are responsible for keeping your payment and contact details up to date.

5. Your 14-day cooling-off period

5.1 If you purchase a membership or pass online or otherwise at a distance (i.e. not in person at the gym), you have the right to cancel within 14 days of purchase for a full refund, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

5.2 To exercise this right, tell us clearly within the 14 days (by email to infinity.membership@infinityfitnessdawlish.com or in person at reception).

5.3 If you ask to start using the facilities during the 14-day period and then cancel, we may charge you a proportionate amount for the period you had access before cancelling.

6. Cancelling your membership

6.1 Monthly memberships are rolling monthly agreements with no minimum term. You may cancel at any time by giving 30 days’ notice.

6.2 To cancel, contact us by email at infinity.membership@infinityfitnessdawlish.com, in person at reception, or through the same channel you used to join. Your membership and payments will continue for 30 days from the date we receive your notice, after which they will stop.

6.3 You remain entitled to use the facilities included in your membership up to the end of the notice period.

6.4 Day Passes and Week Passes cannot be cancelled once purchased except under your 14-day cooling-off right (section 5) or where required by law.

7. Cancelling due to injury, illness or change of circumstances

7.1 In line with Competition and Markets Authority guidance, we will allow you to cancel your membership (and, where appropriate, waive the notice period) if:

  • you suffer an illness or injury, confirmed by a medical professional, that prevents you from using the gym for an extended period; or
  • your circumstances change significantly through no fault of your own (for example, redundancy or relocation away from the area) so that you can no longer reasonably use or afford the membership.

7.2 We may ask for reasonable evidence to support your request. We may also offer to freeze your membership as an alternative (see section 8).

8. Freezing, and changes to prices or facilities

8.1 Freezing: You may ask to freeze your membership for a minimum of one month and up to a maximum of three months in any 12-month period — for example due to illness, injury or travel. A reduced holding fee of £5 per month applies while your membership is frozen, and freeze requests must be made in writing before your next payment date.

8.2 Price changes: We may change membership prices from time to time. We will give you at least 30 days’ written notice of any increase to your monthly fee. If you do not wish to accept the increase, you may cancel in accordance with section 6 before it takes effect.

8.3 Facilities: We may occasionally need to close, alter or remove facilities, classes or equipment (for example, for maintenance, refurbishment or safety). Where a change is significant and ongoing, we will act fairly and, if appropriate, offer a suitable alternative or the right to cancel.

9. Access, security and 24/7 use

9.1 All Inclusive Members may access the gym 24/7 once access control has been set up at reception during staffed hours.

9.2 Membership is personal and non-transferable. Your access fob or credential must not be shared, and you must not allow anyone else to enter using it. Lost or stolen fobs must be reported to reception immediately (a replacement fee may apply).

9.3 Tailgating — entering behind another member without scanning your own fob, or holding doors open for people you do not know — is strictly prohibited, as it affects the safety and security of all members, and may result in suspension of membership.

9.4 During unstaffed hours you use the gym at your own risk. You should familiarise yourself with the location of emergency equipment, alarms and exits, and follow the safety guidance provided.

9.5 We may refuse entry, withdraw access or terminate membership where access rules are breached.

10. Health, safety and your responsibility

10.1 You must complete a health questionnaire (PAR-Q) before using the gym and tell us about any medical condition, injury, recent surgery, pregnancy or other factor that may affect your ability to exercise safely. You must complete an updated health declaration when requested.

10.2 You should not exercise beyond your own abilities. If you know or have reason to believe your health is not suitable for exercise, you must get medical advice before using the facilities.

10.3 You are responsible for exercising safely, using equipment correctly and following instructions and signage. Only use equipment you have been instructed on or are confident using safely; if you are unsure, ask a member of staff. Do not use equipment that appears damaged or faulty — report defects to staff immediately. Do not drop free weights, and always use collars on barbells.

10.4 If you feel unwell, dizzy, or experience chest pains or shortness of breath while exercising, you must stop immediately and seek assistance.

10.5 On arrival, familiarise yourself with the location of emergency exits, first aid kits, the defibrillator (AED) and fire assembly points. In an emergency, leave by the nearest safe exit, assemble at the muster point, and do not re-enter until told it is safe. If you witness a medical emergency, alert staff at once or call 999.

11. Recovery suite — sauna and ice bath

11.1 Use of the sauna and ice bath is at your own risk and is not suitable for everyone. Do not use them if you are pregnant, have a heart condition, high or low blood pressure, or any other condition that may be affected by heat or cold exposure, or if you are under the influence of alcohol or drugs — seek medical advice first if in any doubt.

11.2 You must follow all posted safety rules, recommended time limits and instructions from staff when using the recovery suite.

11.3 Members must be 18 or over to use the sauna and ice bath unless we agree otherwise in writing.

12. Member conduct

12.1 You must treat other members, guests and staff with courtesy and respect at all times. We operate a zero-tolerance approach to the following, any of which may lead to suspension or termination of membership without refund:

  • verbal abuse, threatening language, intimidation or physical aggression towards any person;
  • harassment, bullying or discriminatory behaviour of any kind, including on the basis of any protected characteristic under the Equality Act 2010;
  • unwanted physical contact with other members or staff;
  • offensive, obscene or inappropriate language or behaviour.

12.2 Mobile phones may be used for music, fitness apps or communication provided they do not disturb others. Photography and video recording are strictly prohibited in all changing room and shower areas. You must obtain a person’s prior consent before photographing or filming them anywhere in the facility, and must not post images or videos of other members, staff or the premises online without appropriate consent.

12.3 We are not responsible for content posted by members on personal social media accounts.

13. Classes and bookings

13.1 Group classes are included with the Infinity Membership, and Horizon Members receive one free taster class. Classes are subject to availability and must be booked in advance through our booking system or app.

13.2 If you cannot attend a booked class, please cancel at least 12 hours before it starts so the space can be offered to another member. Members who repeatedly miss booked classes without cancelling may have their booking privileges reviewed.

13.3 We may change, cancel or substitute classes, timetables or instructors. Where we cancel a class you have booked, we will let you know and offer an alternative where possible.

14. Gym etiquette

14.1 During peak hours, share equipment courteously and allow others to “work in” between sets. Keep rest periods on a machine or bench to a reasonable length when others are waiting, and do not reserve multiple machines or stations at once.

14.2 Wipe down equipment after each use with the cleaning materials provided, use a personal sweat towel on benches, mats and upholstered equipment, and return all weights and accessories to their designated storage after use.

14.3 Appropriate sportswear and clean, indoor-use footwear must be worn at all times on the gym floor. Do not leave personal belongings on the gym floor or on equipment. Please maintain a reasonable standard of personal hygiene and avoid excessive use of strong fragrances in training areas.

15. Guests

15.1 Members wishing to bring a guest must register them at reception and pay the applicable guest fee (shown on our Plans & Pricing page) in advance. Guest visits are limited to three per calendar month per member.

15.2 Guests may attend during staffed hours only, and members are responsible for the behaviour of their guests at all times.

16. Prohibited substances

16.1 Alcohol must not be consumed or possessed on the premises unless provided or explicitly authorised by management at a specific event. Members who appear to be under the influence of alcohol or drugs will be refused entry or asked to leave.

16.2 The use, possession or supply of illegal substances on the premises is strictly prohibited and will result in immediate termination of membership and referral to the police. The use of performance-enhancing drugs (including anabolic steroids) is strongly discouraged and may result in suspension of membership.

17. Personal training

17.1 Only Personal Trainers engaged by or formally approved by Infinity Fitness may provide personal training services on the premises. Unauthorised personal training — including coaching, programming or instruction for payment — is strictly prohibited and will result in immediate cancellation of membership. A list of approved Personal Trainers is available from reception.

18. Personal property and lockers

18.1 Lockers are provided for use during each visit only; items must not be stored overnight. Any items left after closing will be held at reception for seven days, after which they may be disposed of or donated to charity.

18.2 Please do not bring valuables to the gym and keep belongings secure in the lockers provided.

19. Our liability

19.1 We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud.

19.2 Subject to clause 19.1, we are not responsible for loss or damage that is not foreseeable, or for loss, theft of or damage to your personal property brought onto the premises, except where caused by our negligence.

19.3 We are not liable for any failure or delay in providing facilities caused by events outside our reasonable control.

20. CCTV and data protection

20.1 CCTV operates throughout the premises (except changing rooms and toilets) for the purposes of security and member safety, including during unstaffed hours.

20.2 We process your personal data (including health information you provide) in accordance with the UK GDPR and the Data Protection Act 2018, and in line with our Privacy Policy, which is available on our website. We will not share your information except as described in our Privacy Policy or as required by law.

21. Suspension or termination by us

21.1 We may suspend or terminate your membership (with a refund of any period paid for but not used, where fair) if you seriously or repeatedly breach these terms, put the safety of others at risk, or fail to make payment. In serious cases we may remove you from the premises and, where appropriate, involve the police. Incidents may be formally recorded and shared with relevant authorities where appropriate.

21.2 Termination does not affect any rights or payments that have already accrued.

22. Complaints

22.1 We want you to be happy with your membership. If something is wrong, please speak to a member of staff or email infinity.membership@infinityfitnessdawlish.com and we will do our best to put it right.

23. General

23.1 If any part of these terms is found to be invalid or unenforceable, the remaining terms will continue to apply.

23.2 These terms are governed by the law of England and Wales, and any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
